Florida ready to deploy National Guard as immigration judges

Florida Governor Ron DeSantis is taking border security to an unprecedented level with a bold new plan that would transform how illegal immigrants are processed in the Sunshine State.

Under a proposal submitted to President Donald Trump’s administration, Florida National Guard officers could serve as immigration judges, dramatically speeding up deportation proceedings.

“[We are ready,] from apprehension to detention, even putting some of our people in the National Guard in line to serve as immigration judges, to process this,” DeSantis declared earlier this month.

The plans reveal that Judge Advocate General’s Corps officers (JAGs) are “suitable for training as immigration judges,” with Florida having nine such officers ready to serve.

Immigration judges aren’t part of the judicial branch, but they operate under the executive branch to determine the removal of illegal aliens from the country. 

The federal government would need to activate these National Guard members for this specific purpose.

“JAGs could not support in State Active Duty under the command of the Governor and would be directed/stationed at the needs of the federal government,” the document states.

Florida prepared to handle mass deportations

DeSantis isn’t stopping at judges. 

The proposal outlines how Florida is prepared to rapidly establish facilities capable of holding 10,000 illegal aliens.

“These facilities can be fully operational within 72 hours and require up to 96 hours to begin setup,” the plan reads. “Each detention center would adhere to ICE’s National Detention Standards.”

Florida’s Division of Emergency Management, led by Kevin Guthrie, is also ready to assist with purchasing commercial flights for self-deportation of non-criminal illegal immigrants and can “fly from Florida to a detention center or their nation of origin.”

The Governor made this commitment crystal clear in late April when he stated Florida could send illegal aliens to El Salvador if the federal government requested or approved such action.

“We’re ready to do more,” DeSantis insisted. “We want DHS [Department of Homeland Security] to approve some of our plans.”

Breaking through federal roadblocks

Florida has already entered into 287(g) agreements with the federal government, allowing local officers to apprehend and detain illegal aliens for deportation. 

However, the state notes these agreements still require ICE agents to be present “during many of the operations needed to conduct a comprehensive immigration enforcement operation.”

To overcome this limitation, Florida is asking the federal government to allow all 287(g)-certified officers to serve as “fully-empowered immigration officers.”

“This would enable the State to bypass the operational bottleneck caused by the limited availability of ICE personnel,” the document explains.

Going even further, Florida wants a state-led command structure that would allow coordinating officers to act without prior federal authorization.

“Due to the limitations of the current Federal Executive Order, there has been a lack of leadership coming from the federal government that could be supplemented if the state of Florida were to assume operational control and enable timely decision-making,” the state argues.

Putting words into action

Florida has already bolstered its immigration enforcement capabilities after Senate President Ben Albritton and House Speaker Daniel Perez negotiated provisions with the Governor in a special session earlier this year.

Since then, state-federal cooperation has intensified, most recently with the state’s participation in Operation Tidal Wave.

While Biden’s border policies have allowed millions of illegal immigrants to pour into the country, Governors like DeSantis are helping Donald Trump show what real border enforcement looks like. 

The comprehensive Florida plan demonstrates that states can take meaningful action when the federal government abdicates its responsibilities.
