Joe Biden using a dirty trick in court to achieve policy goals

President Joe Biden’s administration has been writing federal policy behind closed doors with left-wing activist groups through a process known as sue and settle.

A left-wing activist group will sue the Biden administration and the case will be settled out of court by the government.

The two parties will hammer out an agreement behind closed doors that meets their desired left-wing policy outcome.

This allows the Biden administration to claim their hands were tied by a court, while colluding to create open borders.

The left-wing American Civil Liberties Union (ACLU) sued the Department of Homeland Security (DHS) over the circumvention of lawful pathways rule, which blocks foreign nationals who pass through a third country on the way to the U.S-Mexico border from seeking asylum.

Heritage Foundation Border Security and Immigration Center visiting fellow Joe Edlow told The Epoch Times that the Justice Department is willing to settle with the ACLU in the case.

“This is very concerning,” Edlow said. “What you’re seeing here is almost collusion between the Department of Justice and these plaintiff’s groups to end this rule.”

A federal judge was stunned by the Justice Department’s about-face on defending the rule after having previously argued in favor of it.

“The administration’s abrupt about-face makes no sense as a legal matter. Either it previously lied to this court by exaggerating the threat posed by vacating the rule, or it is now hiding the real reason it wants to hold this case in abeyance,” Ninth Circuit Judge Lawrence VanDyke wrote.

Florida and Republican states fighting back against the lawless Biden administration

Florida Attorney General Ashley Moody (R) and Montana Attorney General Austin Knudsen (R) are leading a 20-state coalition with a brief in support of five states trying to stop the Biden administration from using sue and settle schemes for immigration policy.

They noted that the Justice Department has given up defending the circumvention of lawful pathways rules.

“The Biden administration has systematically broken down our public-safety immigration structure through both implementing illegal asylum programs and outright ignoring existing law,” Moody said in a press release. “The idea that states would blindly allow this administration to negotiate behind closed doors with activist organizations is ludicrous. States have a right to be party to any settlement negotiations that will dictate border policy because we have an interest in protecting the safety of our citizens and the resources of our communities.”

The 20-state coalition is trying to allow states to be notified and able to respond to rule changes and stop policy from being written behind closed doors with sue and settle.

Joe Biden will use every trick in the book to try and keep the southern border wide open.
