Joe Biden’s ATF illegal introduces a rule creating universal background checks

Biden’s Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) issued a rule creating universal background checks by treating any private citizens selling or transferring a firearm as a federal firearms dealer.

Selling a gun to a friend or handing a hunting rifle down from father to son would require the gun owner to conduct a background check through the National Instant Criminal Background Check System (NICS).

The ATF announced that it was authorizing this policy through the 2022 Bipartisan Safer Communities Act by clarifying who is considered a firearms dealer.

RINO U.S. Senators John Cornyn and Senate Minority Leader Mitch McConnell worked with Democrats to pass the bill, the first major gun control bill since former President Bill Clinton’s 1994 so-called assault weapons ban, after the school shooting in Uvalde, Texas.

Millions of law-abiding Americans will be turned into criminals for a constitutionally protected activity because of this rule.

The ATF’s goal is to make the barriers so high that no one will ever conduct a private sale or transfer of a firearm.

And forcing every firearm transaction into the NICS system sets the stage for tracking every gun in the country and creating a universal gun registration list.

That is the first step toward mass firearms confiscation. 

Florida sues the ATF over its unconstitutional attack on gun owners

Florida Attorney General Ashley Mood (R) announced that she was filing a federal lawsuit against the Biden ATF over its illegal universal background check rule.

“This is Biden’s latest step in trying to take guns away from law-abiding Americans,” Mood stated. “We are fighting back against this federal overreach that would force thousands of law-abiding gun owners to register as federal firearms dealers and navigate a federal bureaucracy. It’s unlawful and reflects a lack of respect for our Second Amendment rights. We won’t stand for it.”

Her lawsuit argues that the ATF is not clarifying a rule under the Safe Communities Act by issuing such a sweeping change to the definition of a firearms dealer.

“The challenged rule, in fact, goes far beyond the plain text of the BSCA [Safe Communities Act] It purports to force thousands of law-abiding gun owners to register as federal firearms dealers and navigate a federal bureaucracy as a precondition to engaging in constitutionally protected activity,” Moody’s lawsuit states. “The challenged rule is unlawful.”

Any change to the federal law of this magnitude would take an act of Congress and is well outside the authority of the ATF to make unilaterally. 

“ATF does not have authority to promulgate it because ATF’s rulemaking authority is carefully circumscribed,” the lawsuit continued. “But even if it did, the challenged rule unlawfully attempts to depart from the plain meaning of the BSCA to achieve President Biden’s policy goals.”

Joe Biden’s ATF is taking a final swing at gun owners in an election with the end of his Presidency potentially in sight.
